Welcome to SideEye. Please read these Terms of Service ("Terms") carefully before using the SideEye application and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

1. About SideEye

SideEye is a peer-to-peer screen sharing application designed for gaming squads. Our Services utilize P2P technology to enable real-time screen sharing with transparent overlay capabilities.

2. Acceptance of Terms

By creating an account, downloading, installing, or using SideEye, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our Services.

3. Eligibility

You must meet the following requirements to use SideEye:

  • Be at least 13 years of age (or the age of majority in your jurisdiction)
  • Have a Windows 10 or later operating system
  • Have a stable internet connection
  • Not be prohibited from using the Services under applicable laws
  • Not have been previously banned or suspended from SideEye

Users under 18 years of age should obtain parental or guardian consent before using SideEye.

4. User Accounts

4.1 Account Creation

To use certain features of SideEye, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized use of your account
  • Be responsible for all activities that occur under your account

  • Use another person's account
  • Sell, transfer, or sublicense your account

5. Service Description

5.2 Free Service

SideEye is currently provided free of charge. We reserve the right to introduce paid features or subscriptions in the future with advance notice to users.

5.3 Beta Status

SideEye may be in beta or early access status. You acknowledge that the Services may contain bugs, errors, or incomplete features. We appreciate your feedback and patience as we continue to improve.

6. Acceptable Use Policy

6.1 Permitted Use

You may use SideEye for lawful, personal, non-commercial purposes related to gaming and team coordination.

6.2 Prohibited Activities

You agree NOT to:

  • Stream or share content that violates any laws, regulations, or third-party rights
  • Share content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
  • Violate game publishers' terms of service or anti-cheat policies
  • Use SideEye for commercial streaming without authorization
  • Attempt to gain unauthorized access to other users' accounts or systems
  • Reverse engineer, decompile, or disassemble the SideEye application
  • Remove or modify any copyright, trademark, or proprietary notices
  • Use automated scripts, bots, or scrapers with the Services
  • Transmit viruses, malware, or harmful code
  • Interfere with or disrupt the Services or servers
  • Impersonate any person or entity
  • Collect or harvest user information without consent

7. Content and Intellectual Property

7.1 Your Content

You retain ownership of any content you stream or share through SideEye. By using our Services, you grant us a limited, non-exclusive license to transmit your content to facilitate the peer-to-peer connections.

7.2 Our Intellectual Property

SideEye, including the application, logo, design, features, and all related intellectual property, is owned by SideEye and protected by copyright, trademark, and other laws. You may not use our intellectual property without written permission.

7.3 Third-Party Content

You are responsible for ensuring you have the right to stream or share any content, including game content. SideEye is not affiliated with any game developers or publishers.

8. Privacy and Data

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

8.1 Peer-to-Peer Technology

SideEye uses P2P peer-to-peer connections. Your IP address may be visible to other members of your squad during active streaming sessions.

8.2 Data Retention

We do not store or record your screen sharing content. Streams are transmitted directly between peers and are not saved on our servers.

9. Disclaimers and Limitations

9.1 Service Availability

SideEye is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. We do not guarantee:

  • Uninterrupted or error-free service
  • Compatibility with all games or applications
  • Specific streaming quality or performance
  • That the Services will meet your requirements

9.2 Performance Disclaimer

Stream quality, latency, and performance depend on various factors including your internet connection, hardware specifications, network conditions, and the number of active connections. We cannot guarantee specific performance levels.

9.3 Anti-Cheat Compatibility

The overlay feature may not be compatible with certain anti-cheat systems or full-screen applications. Use SideEye in accordance with game publishers' terms of service.

9.4 No Warranty

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIDEEYE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIDEEYE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use the Services
  • Unauthorized access to or alteration of your transmissions or data
  • Third-party conduct or content on the Services
  • Compatibility issues with games or anti-cheat systems
  • Network or hardware failures

IN NO EVENT SHALL SIDEEYE'S TOTAL LIABILITY EXCEED $100 USD OR THE AMOUNT YOU PAID TO SIDEEYE IN THE LAST 12 MONTHS, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless SideEye, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

  • Your use of the Services
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you stream or share through SideEye

12. Termination

12.1 Termination by You

You may stop using SideEye at any time by uninstalling the application and discontinuing use of the Services.

12.2 Termination by Us

We reserve the right to suspend or terminate your access to SideEye at any time, with or without notice, for any reason, including:

  • Violation of these Terms
  • Fraudulent, abusive, or illegal activity
  • Extended periods of inactivity
  • Discontinuation of the Services

12.3 Effect of Termination

Upon termination, your right to use the Services will immediately cease. Provisions that by their nature should survive termination will survive, including intellectual property rights, disclaimers, indemnification, and limitations of liability.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

  • Posting a notice in the SideEye application
  • Sending an email to your registered email address
  • Updating the "Last Updated" date at the top of these Terms

Your continued use of SideEye after changes become effective constitutes acceptance of the modified Terms.

14. Governing Law and Disputes

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to conflict of law principles.

14.2 Dispute Resolution

Any disputes arising out of or relating to these Terms or the Services shall first be attempted to be resolved through good faith negotiations. If negotiations fail, disputes may be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

14.3 Class Action Waiver

YOU AGREE THAT DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS ONLY AND NOT AS PART OF A CLASS ACTION OR CONSOLIDATED PROCEEDING.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SideEye regarding the Services.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

15.3 Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.

15.4 Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign these Terms without restriction.

15.5 Force Majeure

SideEye shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control.
